Background    
     
   

This vacancy is open for the applicants with the citizenship of an OSCE participating State, excluding the Republic of Serbia.

The OSCE Mission to Serbia is looking for an international expert to assist the OSCE War Crimes Trial Monitoring Team in drafting the follow-up on recommendations from the Mission’s multi-annual report "War Crimes Proceedings in Serbia (2003-2014)".

The OSCE Mission to Serbia has been monitoring all war crimes proceedings before the Higher Court in Belgrade and the Court of Appeals in Belgrade, and has published its first comprehensive war crimes trials monitoring report "War Crimes Proceedings in Serbia (2003-2014) - An Analysis of the OSCE Mission to Serbia’s monitoring results" in 2015. The findings contained in the report were based on the analysis of a large volume of data collected through monitoring of war crimes proceedings held in Serbia between 2003 and 2014, and it was based primarily on legislation, indictments, judgements, and other judicial decisions. In some cases, the research was complemented by interviews with judges, prosecutors, police officers, lawyers and representatives from international and civil society organizations.

As envisaged by the extra-budgetary project "Support to Monitoring of National War Crimes Trials (Phase II)", a comprehensive multi-annual report will include an in-depth comparative analysis of war crimes proceedings in Serbia and in the region of the former Yugoslavia, as well as analysis of the reflections of humanitarian law jurisprudence of international criminal courts to war crimes trials in Serbia. The report should also include follow-up on recommendations from the Mission’s multi-annual report "War Crimes Proceedings in Serbia (2003-2014)".

     
Tasks and Responsibilities    
     
   

Under the supervision and in consultation with the National Legal Officer, the expert will be responsible for:

  1. Conducting in-depth analysis of the relevant documents in domestic war crimes cases in Serbia;
  2. Preparing comprehensive questionnaires for structured interviews with Serbia’s legal practitioners – prosecutors, judges, defence lawyers, police officers dealing with war crimes cases and possibly other actors involved (such as independent legal experts or CSO representatives);
  3. Conducting interviews with aforementioned legal practitioners;
  4. Drafting the follow-up on recommendations from the Mission’s multi-annual report "War Crimes Proceedings in Serbia (2003-2014)".
     
Necessary Qualifications    
     
   
  • Citizenship of an OSCE participating State, excluding the citizenship of the Republic of Serbia;
  • Advanced university degree in economics or law (MA or PhD);
  • Excellent knowledge of international humanitarian law and of the ICTY practice jurisprudence;
  • Excellent knowledge of relevant norms of Serbian or similar legislation applicable to war crimes, criminal procedure law and organization and functioning of the judicial systems in Serbia;
  • Excellent knowledge of jurisprudence of the courts in the region, with focus on the jurisprudence of Belgrade Higher Court’s and Appellate Court’s War Crimes Department;
  • Excellent knowledge of criminal procedure, criminal law and organization and functioning of the judicial systems in Serbia and the region of former Yugoslavia;
  • At least 7 years of experience in the above mentioned fields;
  • Professional fluency in English, both oral and written. Knowledge of Serbian would be an asset;
  • Computer literate with practical experience in Microsoft packages;
  • Ability and willingness to work with people of different cultural, national and religious backgrounds;
  • Demonstrated gender awareness and sensitivity, as well as the ability to integrate a gender perspective into tasks and activities.

Remuneration Package    
     
   

The expert will be employed on a Special Service Agreement covering a total period of 2 months, starting approx. from 1 August 2019, and will be paid a total amount not exceeding 5,000 EUR, commensurate to individual qualifications and experience.

In addition, the OSCE Mission to Serbia will cover travel and accommodation costs, if any, associated with this consultancy.
