Background information:
In the framework of its Programme “Human Security”, the OSCE Project Co-ordinator in Ukraine (PCU) together with the Ministry of Internal Affairs and National Police of Ukraine (NPU) implements the Project “Supporting the Ministry of Interior and National Police of Ukraine in Addressing Domestic Violence, Human Trafficking and Cybercrime in Ukraine”. The Project addresses the need of the National Police in developing a model procedure for handling and protecting personal data in the police. In September 2020, according to the Law of Ukraine “On Protection of Personal Data”, the Human Rights Protection Department(HRPD) of the NPU established a specialised analytical unit for the organization of personal data processing and protection in the National Police. One of the main tasks of the specialized unit is to ensure safety of personal data processing by police taking into account human rights-based approach. In 2021, the PCU will support the HRPD and hire national experts to develop a model procedure for handling and protecting personal data in the police and pilot the drafted order to make sure it meets the needs of the police staff in the field.
Please note that this is a short-term consultancy assignment. The consultant will work from home and, should pandemic allow, will be required to travel to participate and deliver trainings in different regions of Ukraine.
Tasks:
The engaged expert (in co-operation with other two experts) will develop a model procedure for handling and protecting personal data in the police, taking into account national and international legislation in the sphere of data protection, as well as human rights-based approach. The national experts engaged by the PCU will work jointly with the NPU and its practitioners, as well as civil society representatives. In particular, the engaged expert will have to perform the following tasks:
1. Develop the model procedure for handling and protecting personal data in the police:
• Analyse national and international good practices in the sphere of data protection;
• Develop a draft model procedure for handling and protecting personal data in the police in line with operational requirements of the NPU;
• Provide expert support and facilitate a series of working group meetings to discuss a draft model procedure;
• Integrate gender component into the model procedure;
• Develop recommendations regarding the implementation of model procedure as well as needs for further development of legal framework in the sphere;
• Finalise the model procedure based on the results of the piloting trainings.
2. Conduct two piloting trainings to test the draft model procedure in practice, improve and finalize it:
• Prepare the piloting training agenda, training materials and hand-outs, as well as pre- and post-training questionnaires (to be approved by the OSCE PCU);
• Conduct two 2-day trainings for police practitioners (exact cities TBC at a later stage);
• Collect, analyze and integrate the results of piloting into the draft model procedure for handling and protecting personal data in the police for its finalization.
Necessary Qualifications:
• University degree in law;
• Minimum 5 years of relevant professional experience at national and/or international level;
• Proven in-depth knowledge and understanding of issues related to protection of personal data, in particular for police operational procedures;
• Experience in analyzing and drafting legislative acts;
• Training delivery experience;
• Excellent command of Ukrainian, with exceptional oral and writing skills;
• Computer literacy;
• Self-discipline and ability to work against deadlines.
Remuneration Package: According to the PCU consultancy fees guidelines.
