Background    
     
   

This vacancy is open only for the applicants with the citizenship of or permanent residence in the Republic of Serbia.

Taking into account the needs for legal certainty in dealing with crypto-assets and harmonization with the global and European trends, the OSCE Mission to Serbia will support the Securities Commission of the Republic of Serbia (SEC) by assisting the regulatory process through engagement of an expert advice. The Securities Commission is participating (and taking a key role) in the Government's working group for regulation of crypto-assets. The draft Law that is currently being prepared by the working group is supposed to cover the regulatory aspects of crypto-asset related business operations, and the SEC is to be appointed as the competent authority regarding the implementation of the majority of the Law. The goal is to regulate the issuance of crypto-assets, as well as the provision of crypto-related services.

Crypto-assets are a new type of property, which need to be treated differently from both financial instruments on one side, and from fiat currencies on the other side. This practically means that the new statutory framework (which includes the new Law and the by-laws) will need to take into consideration the special position of the crypto-assets in the financial system, as well as risks inherently related to the technology underlying them. For this reason, the successful completion of the tasks of the SEC in regard to the Law drafting process would require the engagement of a consultant experienced with introducing new elements to the financial market, as the new framework needs to both tackle the (quite significant) risks without impeding development. Once the Draft Law is produced, the expert’s assistance is also needed in order to present the document to the general public.

     
Tasks and Responsibilities    
     
   

Under the supervision of Senior Anti-corruption Adviser, the consultant will be responsible for:

  1. Providing guidance during the Law drafting process through participating in daily calls with the SEC employees, meetings with the SEC employees (in person or online), and communication via e-mail;
  2. Providing substantive advice by preparing comments on the initial and final drafts of the Law on Crypto-assets;
  3. Reviewing the final version of the Law on Crypto-assets;
  4. Preparing the presentation of the Law on Crypto-asset for the general public.

The consultant will perform all tasks from home, except the presentation part which will take place on a location set by the SEC, which he/she will attend via electronic means or in person if the circumstances allow, with full respect of prescribed protection measures against COVID-19 infectious disease.

     
Necessary Qualifications    
     
   
  • Citizenship of or permanent residence in the Republic of Serbia;
  • University degree in economics or law;
  • Minimum 5 years of professional experience in the field of capital markets;
  • Good knowledge of anti-money laundering processes and a proven experience with crypto-assets;
  • Previous experience in drafting laws and by-laws;
  • Experience in working for a regulatory body would be considered as an advantage;
  • Knowledge of the Serbian or equivalent anti-money laundering legal framework would be considered an asset;
  • Professional fluency in English language, both oral and written;
  • Computer literate with practical experience in Microsoft packages;
  • Ability and willingness to work with people of different cultural, national and religious backgrounds;
  • Demonstrated gender awareness and sensitivity, as well as the ability to integrate a gender perspective into tasks and activities.

Remuneration Package    
     
    The consultants will be employed on a Special Service Agreement covering a total period of one and a half months, starting approx. in mid-September 2020, and will be paid a total amount not exceeding RSD 283,000 in total, commensurate to individual qualifications and experience.
