Location: Dushanbe, Tajikistan Duration of assignment: 10 April – 10 July 2018 Today in Tajikistan 32 television channels are in operation, of which 12 are government-owned, 15 are independent, and five are cable ones. In addition, 28 audio and video production studios operate. In rural areas, users generally use TV and Radio as their information source. Newspaper circulation is very small and almost 84% of population of Tajikistan receive information through TV channels. In September 2017 the Committee on TV and Radio established a new Working Group on digital switchover composed of relevant government structures and representatives of civil society and adopted the Action Plan for the Working Group to work in direction of developing the digital broadcasting in Tajikistan. According to this Action Plan the working group is tasked to define the main objectives of the transition from analogue to digital broadcasting i.e. legal regulation, technical and other issues of the digital broadcasting in the country. During the meeting in October 2017, representatives of the Working Group on Transition to Digital Broadcasting under the Committee on TV and Radio (Working Group) requested the OSCE Programme Office in Dushanbe (POiD) to support them in conducting the switchover process. In 2018 the POiD will work closely with the Working Group to ensure the smooth transition process in Tajikistan. Main directions of the OSCE POiD support to the government, civil society and people of Tajikistan in the field of digital switchover are in revising existing legislation and bringing them in line with the OSCE standards, assisting local independent TV channels in developing a modernization plan for their transmitters, organizing a study tour to Lithuania to learn the positive experience of the country conducting public awareness raising campaigns to ensure that citizens get ready for the switchover process, at the same time organize campaign tours to the regions to encourage local authorities to financially support local independent TV channels for smooth transition process.

Tasks and Responsibilities | ||
The National Expert will be assisting the International Expert in gathering needed information and organizing all necessary meetings on spot. Additionally, the national expert will be tasked to support the international expert to: - Review the existing Tajik law in the field of media, inter alia: the Tajik Law on Print and Other Mass Media; the Tajik Law on TV and Radio; the Tajik Law on Information; the Tajik Law on Access to Information; the Tajik Law on Copyright; and other related laws and legal documents in the field of media. Concept on State Policy of Tajikistan in the field of TV and Radio Broadcasting for 2010-2025; - Prepare proposals for amending and changing the above mentioned laws to bring them in line with international standards including the WTO and OSCE commitments in the field of media and requirements of ITU (Geneva-2006) with regard to digital broadcasting; - Provide the POID with report and recommendations for improving Tajik law in connection with the country's transition to digital broadcasting; - Review the legal documents on Internet Regulation in Tajikistan, inter alia: the Tajik Law on Print and Other Mass Media; the Tajik Law on TV and Radio; the Tajik Law on Information and Access to Information; the Penal Code of Tajikistan; other related laws and legal documents on Internet regulation; the President Decree on measures to ensure access to world information networks; the Rules on providing the Internet in Tajikistan; the President Decree on Information Security Concept and the Government Decision on Programme on Information Security of Tajikistan; the Government Decision on State Programme of Development and Implementation of ICT in Tajikistan; President Decree on Concept of State Information Policy of Tajikistan; - Prepare draft amendments and changes to the existing law of Tajikistan to regulate the illegal content in the internet; - Prepare report and recommendations on illegal content regulation in the internet to bring them in line with international commitments of Tajikistan in the field of media. The scope of work can be amended or specified for the purpose of the assignment. |

Necessary Qualifications | ||
Advanced university degree in law, preferably at master level with a focus on media legislation social/political sciences, international relations or related field; A minimum of 5 years’ relevant professional experience in media law. Good knowledge of Tajik media laws and issues around their implementation; Knowledge of the country’s current situation with regard to the transition from analogue into digital switchover broadcasting and challenges they face would be a strong asset; Knowledge on the current situation with the internet illegal content regulation and its challenges to media freedoms and access to information in the country is required; Experience in good governance, human rights, transparency, accountability or similar work would be an advantage; Professional knowledge of Russian language; Proven commitment to the core values of the OSCE POID; in particular, is respectful of differences of culture, gender, religion, nationality, language, age, disability of other status; Responsibility, flexibility, creativity. | ||

Remuneration Package | ||
