Over the past decade, radicalisation to violent extremism has become a matter of pressing public and political concern in Central Asia. In Tajikistan, the threats posed by violent extremism and terrorism are exacerbated by socioeconomic hardship, exposure to organized crime and drug trafficking from Afghanistan. The prison environment in particular can be a potential breeding ground for radicalisation because of the following risks: recruitment of other prisoners; supporting extremist groups from prison; getting support from extremist groups outside prison; preparing for violent extremist/ideological inspired illegal acts after release; hostility to other groups of prisoners and/or staff; becoming more radicalised because of grievances/frustrations/anger related to being in prison. In 2019, the Office supported an expert working group that included an international expert and representatives of the Prison Department to conduct a monitoring and needs assessment of six closed facilities in Dushanbe, Khujand, Vahdad and Nurek in accordance with national legislation and international standards. Based on findings and recommendations from the monitoring and assessment, the Office identified needs that must be addressed in order for the Prison Department to effectively manage violent extremist prisoners and prevent radicalization to violence in prisons. One of main challenges for prison authorities is overcrowded prisons and lack of respective prison conditions. This related to lack of instrument to provide judges with an accessible guide to assist them in dealing with some of the key issues that they face in extremism and terrorism cases. In this regard, Office in close cooperation with the Training Centre of the Supreme Court will develop a judicial handbook on management of extremism and terrorism cases that will be aimed to:
The handbook will contain all relevant national legislation, normative acts and relevant international instruments with explanatory articles and commentaries; and will be useful in related judicial training. In order to achieve the task above, the Office will enter into a Special Service Agreement for the duration of four months with an international consultant. |

Tasks and Responsibilities | ||
In close cooperation with the Training Centre of the Supreme Court and with support of the Rule of Unit, under supervision of International expert, the consultant will undertake the following activities: Task 1: All relevant national and international legislation and instruments reviewed and discussed 1.1. Review and analyse of all relevant national and international legislation and instruments; 1.2. Review and analyse international cases related to extremism and terrorism; 1.3. Review samples and analyse of judicial decisions, degrees, orders and other documents related to judicial management of court cases relating to extremism and terrorism; Task 2: Judicial handbook developed and discussed 2.1. Develop the methodology and indicators for judicial handbook; 2.2. Develop recommendations on judicial management of cases relating to extremism and terrorism; 2.3. Draft handbook for judges on management of court cases related to extremism and terrorism. Task 3: Conduct two-day trainings for the trainers of the Judicial Training Centre 3.1. Develop a training materials and agenda for two-day trainings; 3.2. Conduct two-day trainings for the trainers of the Judicial Training Centre; 3.3. Mentor support to the trainers of the judicial Training Centre who will conduct three two-day trainings for judges. Task 4: Post-assessment report provided 4.1. Final report with follow-up recommendations submitted and approved. Expected Output/Deliverables: (1) Review and analyse of all relevant national and international legislation and instruments (home-based); (2) Review international cases related to extremism and terrorism and develop recommendations on judicial management of such cases (home-based); (3) Review samples and analyse of judicial decisions, degrees, orders and other documents related to judicial management of court cases relating to extremism and terrorism (home based); (4) Develop the methodology and indicators for judicial handbook (home-based); (5) Draft handbook for judges on management of court cases related to extremism and terrorism (home-based); (6) Develop a training materials and agenda for two-day trainings; (7) Conduct two-day training session for the trainers of the Judicial Training Centre (Dushanbe); (8) Mentor support to the trainers of the judicial Training Centre who will conduct three two-day trainings for judges (Dushanbe, Khujand and Bokhtar).
