Background    
     
   

In line with its support initiatives to the Ministry of Economic Development and Trade of the Republic of Tajikistan (MEDT) for further development of Free Economic Zones (FEZs) of Tajikistan, the OSCE Programme Office is planning to conduct the analysis/assessment of the current Legal framework of FEZs of Tajikistan. One significant part of this assessment will include a detailed gap analysis of the current legislation (primary and secondary) indicating the comparison of actual FEZs performance with the existing legislation with potential or desired performance after taking into consideration the suggested legislative changes.

In this regard, the OSCE Programme Office in Dushanbe is looking for a highly qualified National Expert, to conduct this task. The National Expert on FEZ Legal Framework will be coordinating its activities and performing its tasks in coordination with OSCE Programme Office in Dushanbe and the Ministry of Economic Development and Trade. In addition, under the supervision of the International expert, National expert will closely cooperate and coordinate its work with the National Expert on international export market analysis and the International Expert.

Objectives of the assignment:

To provide the MEDT and the OSCE POiD with detailed recommendations for required legislative changes to increase the performance of FEZs in Tajikistan.  

     
Tasks and Responsibilities    
     
   
  • Analyze all laws, regulations, policies and plans regulating the FEZs in Tajikistan;
  • Provide a legislative gap analysis and recommendations of legislative changes considering national specificities and international best practices;
  • Indicate the comparison of actual FEZs performance with the existing legislation with potential or desired performance after taking into consideration the suggested legislative changes.

Expected output and performance indicators:

Legislative gap analysis and proposals of legislative changes necessary for further improvement of performance of the FEZs, in consultation with all relevant stakeholders.

Reports and time schedule:

Expert will submit a final report, comprising of detailing activities undertaken and outlining progress achieved in relation to the objectives of assignment, also stating challenges and constraints.

 

     
Necessary Qualifications    
     
   
  • University degree in Law, Business Law, with at least five years of practice;
  • Experience in legislative reviews and drafting legislation;
  • Familiarity with laws of Tajikistan;
  • Knowledge of FEZs laws, bylaws, regulatory and policy;
  • Excellent written and verbal communication skills in Tajik and Russian, knowledge of English is an advantage;
  • Ability to collect and analyze quantitative and qualitative data;
  • Demonstrated communication skills and team-work;
  • Ability to work independently and under time pressure;
  • Proficiency in Microsoft Office.

Remuneration Package    
     
    The consultant will be remunerated commensurate with consultant’s experience and qualifications in accordance with OSCE established rates. Applicants should indicate whether they wish to be included in the OSCE Roster of Consultants for similar assignments.
