The new Law on Prevention and Protection from Discrimination strengthens the protection of the rights of persons with disabilities, men and women, through inter alia the introduction of a public sector equality duty, as well as providing for reasonable accommodation.
According to the law, reasonable accommodation means necessary and appropriate modification and adjustments not imposing a disproportionate or undue burden, where needed in a particular case, to ensure to persons with disabilities the enjoyment or exercise on an equal basis with others of all human rights and fundamental freedoms. Namely, the purpose of every accommodation is to provide the person with disabilities with access to employment, work and advancement in work, education, access to goods and services etc. The question of what type of accommodation is appropriate can be answered following an individual analysis that will take into consideration the conditions of the person with disabilities, the service required, the cost and similar. Thus, reasonable accommodation is always linked with an individual assessment and individually tailored solution.
The Mission will support the drafting of guidelines on reasonable accommodation according to the Law on Prevention and Protection from Discrimination, and for this purpose, seeks to engage two (2) National Consultants.

- To develop the layout and methodology of drafting the guidelines on reasonable accommodation according to the Law on Prevention and Protection from Discrimination.
- The guidelines will describe and compare different models (mostly definitions available in the national context as well as European best practice models) in relation
- to the provision from the Law on Prevention and Protection from Discrimination specifically referring to reasonable accommodation, taking into account the special needs
- of women with disabilities. A checklist for providing reasonable accommodation will be developed as an integral part of the guidelines and examples for providing reasonable
- accommodation in different areas, such as employment and work relations, education, judiciary and access to goods and services;
- To draft the guidelines on reasonable accommodation according to the Law on Prevention and Protection from Discrimination;
- To conduct one workshop to discuss the draft guidelines;
- To conduct interviews with relevant stakeholders; and
- To regularly coordinate with the OSCE Anti-discrimination Portfolio Manager.
The two consultants will work as a team and implement all tasks jointly.
Deliverables:
- Working plan subject to approval of the OSCE Anti-Discrimination Portfolio Manager;
- Layout and methodology of the guidelines on reasonable accommodation according to the Law on Prevention and Protection from Discrimination;
- The guidelines on reasonable accommodation.

For the services provided, each National Consultant will be remunerated at the rate of 100 EUR per diem, for a total of 10 working days.
Payment will be made in one instalment upon successful completion of all tasks and responsibilities.
The planned period of engagement is May to August 2019.
