Background:

In compliance with its Mandate, the OSCE Presence in Albania supports the Albanian Government and the civil society in the fight against human trafficking, including efforts against child trafficking and various forms of exploitation. To address the complexity of children’s economic exploitation in a systematic and holistic approach, in 2017 – 2018, the Presence provided technical expertise to the Ministry of Health and Social Protection for the development of a National Action Plan for the Protection of Children from Economic Exploitation, including children in street situations; and a by-law on the Identification and Referral of Children in Economic Exploitation.  Through Extra-Budgetary support from the Italian Government, the Presence will provide continuous support to the child protection structures towards the proper implementation of the National Action Plans and relevant legislation that address child trafficking and economic exploitation. 

In order to support the above, the OSCE Presence in Albania is seeking one international and one national consultant to draft a policy paper that will guide the Albanian State Labour Inspectorate in monitoring, collecting data and providing analytical reports on children’s work in Albania.

 

Tasks and responsibilities:

The National Consultant will develop a policy paper based on consultations with the OSCE Presence Project Manager, desk research, meetings with the State Labour Inspectorate Focal Point and the international consultant. The policy paper shall provide a legal analysis, findings and recommendations on the following topics, in accordance with the format described under the Deliverables section below.

1. An overview of the Albanian Labour Code and by-laws related to children’s work, including an analysis of their compliance with the international legal framework on children’s work, ratified by Albania; An overview of the Albanian child protection framework, with specific consideration to the Law 18/2017 “On the rights and protection of the child” and its sublegal acts; An overview of the role of the labour inspectors for the identification and referral of cases pertaining to children working against the legal provisions in force;

2. An overview of the labour inspection system in Albania, with a specific focus on the inspection of children’s work and the data collection and reporting tools for the labour inspectors; 

3. Recommendations on the actions to be undertaken by the labour inspectors to identify and refer cases of children performing work against the provisions of the Albanian Labour Code and actions to prevent children’s exploitation and/or trafficking;

4. Recommendations on the format and content of a statistical report for labour inspectors to collect and report quantitative data on children’s work, disaggregated according to the Albanian Labour Code provisions pertaining to work conditions, types of work, age, gender.  

Deliverables:

• A draft report (policy paper) in English language, between 30 to 35 pages, in Times New Roman, font size 12, containing all the above;

• Participation in five to seven consultation meetings with the OSCE project Manager, the State Labour Inspectorate and the international expert. The meetings shall be arranged by the OSCE Presence;

• A revised draft report based on the recommendations of the meetings and of the Project Manager;

• Presentation of the report and recommendations in a workshop in Albania, to be organized by the OSCE Presence.

 

Necessary Qualifications  

• Higher education in Law, Political Sciences, Social Sciences, Economics, International Development or other related fields;

• A minimum of eight (8) years of work experience as researcher, consultant, specialist in policies addressing the inspection of children’s work;

• Previous experience in working in the area of tackling child trafficking, exploitation;

• Very good knowledge of the Albanian labour inspection system and child protection framework;

• Excellent analytical and writing skills;

• Excellent communication and presentation skills in English and Albanian;

• Knowledge of the OSCE anti-trafficking commitments will be an added advantage; 

• Fully-computer literate.

Remuneration

The payment for this consultancy is 2,250 Euros, payable upon submission of the above mentioned deliverables and their approval by the Project Manager.
