Background    
     
   

This vacancy is open only for the applicants with the citizenship of or permanent residence in the Republic of Serbia.

The OSCE Mission to Serbia is looking for a number of experts in the field of media legislation and/or the fields of electronic communications legislation, copyright and related rights, media-specific public procurement, sponsorships, donations and state aid, labour legislation, and antimonopoly regulation, who may be engaged in one or more of the Mission’s current or future projects.

The Government of the Republic of Serbia adopted the Strategy for the Development of Public Information System in the Republic of Serbia for the Period 2020-2025 (the “Media Strategy”) on 30 January 2020, following a wide participatory process supported by the OSCE Mission to Serbia.

The overarching goal of the Media Strategy is to foster the improvement of the public information system “through a harmonised positive legal framework which guarantees the freedom of expression, freedom of media, safety of journalists, media pluralism, developed media market, empowered journalist profession, educated citizenry, and institutions capable of implementing the legislation.” This goal is elaborated in five objectives and their respective measures and indicators:

  1. Improved safety, socioeconomic, and professional environment for the work of journalists and other media professionals;
  2. Established functional, sustainable, and fair media market, protected against political influence;
  3. Functional, competent, professional, and open institutions with available mechanisms for protection against external pressure, which are consistently implementing public policies and regulations;
  4. Quality, plural, and diverse media content satisfying the information needs of different social groups;
  5. Enhanced professional knowledge and developed digital competences of individuals, institutions, media, journalists, and other media professionals.

The Media Strategy directly regulates some of the issues, while other issues are left to the future drafting and adoption of policy and/or legal documents, such as the Action Plan for the implementation of the Media Strategy. This first Action Plan will cover the three-year period (2020 – 2023) and, once adopted, legislation in place will be amended so as to reflect solutions envisaged by the Media Strategy.

In order to ensure transparent, inclusive and fact-based process of drafting new media legislation, it is crucial to provide sound legal analysis of the current framework and Media Strategy goals and its implementation and to propose necessary improvements.

To this end, the Mission requires the services of highly qualified experts in the field of media legislation, who would be responsible for providing legal analysis from their field of expertise, in order to provide a well-researched and broadly disused factual basis for future legislative efforts in continuation of the media reform.

     
Tasks and Responsibilities    
     
   

Under the supervision of the National Legal Officer, the experts will be responsible for:

  1. Contributing to streamlining the overall objective of the Media Strategy and its Action Plan in concrete legislative amendments;
  2. Analysing the legislation in force, the international standards, the EU accession requirements and most recent trends in Western democracies relevant for the media and freedom of information
  3. Suggesting changes necessary for the successful implementation of the Media Strategy and its Action Plan, based on the analysis of the aforementioned documents;
  4. Analysing de facto media situation in the country and how the proposed amendments would impact the plurality of independent sources, availability of independent public interest content, the position of journalists and/or media market;
  5. Interviewing the relevant stakeholders (from institutions, regulatory bodies, journalists’ and media associations, academia, civil society, chamber of commerce etc.) as part of the analysis;
  6. Participating in the debate on the draft document and, if deemed appropriate, fine-tune the final version.
     
Necessary Qualifications    
     
   
  • Citizenship of or permanent residence in the Republic of Serbia;
  • University degree in law;
  • Minimum 5 years of relevant professional experience in the field of media legislation and/or the fields of electronic communications legislation, copyright and related rights, media-specific public procurement, sponsorships, donations and state aid, labour legislation, and antimonopoly regulation;
  • Profound knowledge of the legal system, media legislation and media system of the Republic of Serbia;
  • Experience in conducting legal and/or social research would be considered an asset;
  • Knowledge of international media and human rights standards and regulations;
  • Knowledge of human rights, administrative law, business legislation including intellectual property, labour law, and electronic communication law would be an asset;
  • Professional fluency in English language, both oral and written;
  • Computer literate with practical experience in Microsoft packages;
  • Ability and willingness to work with people of different cultural, national and religious backgrounds;
  • Demonstrated gender awareness and sensitivity, as well as the ability to integrate a gender perspective into tasks and activities.

Remuneration Package    
     
   

The selected experts would be put on the Mission’s consultancy roster and may be engaged on a Special Service Agreement for specific projects and activities, and they would be remunerated in accordance with the Mission’s remuneration policy valid at the time engagement, commensurate to individual qualifications and experience (for the purpose of illustration, currently up to 190 EUR per day, up to 1,800 EUR per month). The inclusion of the roster does not constitute an obligation or promise of engagement or employment.
