Background    
     
   

Under its Project “Enabling Greater Accountability for Governance Effectiveness (ENGAGE)”, the Governance Section (GS) seeks to support the Assembly of Kosovo parliamentary group “Srpska lista” in improving quality of their input in legislative process. The parliamentary group “Srpska lista” have showed significant interest in receiving legal expert to support them in their daily work. As a result of the assistance, the deputies will be able to fully utilize available institutional mechanisms and parliamentary oversight tools and increase their output in the Assembly committee meetings and the Assembly plenary sessions.

Objective

The parliamentary group “Srpska lista” require the services of one experienced legal expert to provide legal opinions, written reviews on draft laws, advice on procedural issues and any legal advice as requested, as well as provide assist and support in implementing parliamentary oversight activities through parliamentary proceedings and mechanisms. The main but not only focus of their activities will be the Committee on Rights, Interest of Communities and Returns (CRIC).

     
Tasks and Responsibilities    
     
   

Under the overall supervision of the Chief of Governance Section and in coordination with the respective head of the parliamentary group, the legal expert will be responsible for provision of legal support and advice to “Srpska lista” parliamentary group. The legal expert will report to the head of the parliamentary group.

The tasks of the Legal Expert will be to:

  • Provide legal opinions to all members of the parliamentary groups on draft laws and other motions that are being reviewed in the AoK
  • Support the parliamentary groups in implementing parliamentary oversight activities through parliamentary proceedings and mechanisms
  • Provide advice to the parliamentary groups on interpretation and implementation of legal acts
  • Actively support Assembly members in their work in the Assembly committees and Assembly Presidency
  • The advice will be provided verbatim or in writing, depending on the decision of the head of the parliamentary group
  • The expert will treat all communication confidential, also towards OSCE, and share information exclusively with the parliamentary group

Deliverables

  • 1 report per month on the legal opinions provided to all members of the parliamentary group on draft laws or any other legal acts (not including the contents of the advice and respecting the need for confidentiality). Reports signed by the head of the parliamentary group, and delivered to OMiK.
  • Final report by the end of the contract, respecting the need for confidentiality and delivered to OMiK.

Performance Indicators

  • Effective and efficient communication with all members of the parliamentary group
  • The Project manager will confirm the quality of monthly and final report submitted by consultant
  • Flexible on possible new instructions to be taken into consideration which may derive from the GS team through his/her assignment
  • Timely submission of all the deliverables and other products that are foreseen with this TORs.  
     
Necessary Qualifications    
     
   
  • First-level university degree in law and a legal background with an emphasis on parliamentary and legislative/political work, preferably within Kosovo
  • At least five years relevant professional experience, preferably in drafting legal opinions or laws
  • Interest and knowledge of community rights issues, a focus on Kosovo legal framework is an asset
  • Excellent organizational skills with capacity to deal effectively with changing priorities
  • Ability to cooperate with team members and communicate effectively in a multicultural environment
  • Command of Windows software, Microsoft Office and Microsoft Outlook
  • Ability to keep strict deadlines and deal with several activities simultaneously
  • Fluent in Serbian, working knowledge of English. Additional knowledge of Albanian language is an asset
     
Remuneration Package    
     
    Remuneration will depend on the qualifications and experience of individual experts as well as the detailed work plan to be agreed upon and will be based on the current OSCE consultancy rates.
