|
Given that digitalization in the Kyrgyz Republic gains an increasingly large scale and covers serious industries, and in view of growing threats, as well as pursuant to governmental initiatives and programmes, the corresponding measures to strengthen the national cybersecurity potential by providing legal assistance are planned by POiB in 2021 in co-operation with the cybersecurity state agencies.
Projects on digitalization of public services, the transfer of public administration and the national economy to a digital format are planned within the program of the Government of the Kyrgyz Republic for the implementation of the Concept of digital transformation and the Cybersecurity Strategy of the Kyrgyz Republic for 2019-2023.
Considering the rapid development of Cyber/ICT sphere, there is a need for updating the legal framework and harmonizing the national legislation, by developing regulations and standards on cybersecurity in the Kyrgyz Republic. |

Tasks and Responsibilities |
|
|
|
|
|
|
|
Under the supervision of Project Manager, the consultant will perform the following tasks:
- To participate as an expert in all activities (working meetings, official visits and events, presentations, round tables, etc.) related to legal aspects of Cyber/ICT security in the Kyrgyz Republic;
- To carry out research of the legal framework in the field Cyber/ICT security of the Kyrgyz Republic;
- To carry out a comparative analysis of the existing legislation of the Kyrgyz Republic with foreign laws on Cyber/ICT security (CIS countries, EU, etc.);
- To develop relevant legislative documents necessary for harmonization of national Cyber/ICT security legislation;
- To prepare a relevant analytical report, recommendations, and amendments for updating the national legal documents on Cyber/ICT security; follow up with all national actors involved in Cyber/ICT security;
- To support Coordination Centre for Cybersecurity on any legal issues and aspects, in particular during legal review, public discussion of draft regulations; to take part at meetings, working sessions and other related events as required, including submission of recommendations and relevant draft laws on Cyber/ICT security to the appropriate decision-makers; follow-up with the state agencies for further adoption of the laws and their implementation;
- To coordinate the approval process of documents with the Government and, if needed, further with the Parliament;
- To provide methodological assistance and direct participation in the analysis of regulatory impact and the development of justification;
- To participate in the preparation of any documents needed to launch and implement Cyber/ICT legislation, including decrees, instructions, and other materials;
- To organize working groups meetings on developing national legal framework on Cyber/ICT security;
- To draft, edit and present developed documents and responsible sections of reports; all such documents and written reports should be presented to the HPMD and NCTO;
- To prepare SSA Deliverables Report (if necessary with attachment of more detailed report);
- To prepare the written inputs on legal aspects of Cyber/ICT security in English/Russian on an ad hoc basis as requested.

Necessary Qualifications |
|
|
|
|
|
|
|
- Bachelor's or Master's degree in law from an accredited university;
- Practical experience in legal reform (not less than five (5) years);
- Previous experience of conducting desk review of national legislation and development of regulatory legal acts;
- Experience of work with state agencies;
- Advanced experience in providing legal support/advisory support, conducting research and needs assessment;
- Knowledge of international law and domestic law; procedure for adoption and ratification of legal normative acts;
- Knowledge of international legal procedures and standards, particularly, among others, the OSCE and UN best practices in Cyber/ICT Security;
- Strong drafting and reporting skills in Russian and English;
- Excellent knowledge of Russian and Kyrgyz. Good command of English at the level of understanding written texts on topics related to the tasks and providing the required and requested information;
- Excellent communication skills, flexibility, demonstrated analytical skills, and maturity of judgement;
- Demonstrated ability and willingness to work as a member of a team and with people of different nationalities, religions and cultural and professional backgrounds as well as different gender, diverse political views and approaches to problems, while maintaining impartiality and objectivity;
- Good knowledge of the OSCE mandate and its area of operation; previous assignments within the OSCE or another international organization would be an asset;
- Experience in similar assignments is an advantage.

Remuneration Package |

Remuneration will depend on the selected consultant’s qualifications and experience and be in accordance with OSCE established rates. |
