Brief description of required services:

The engaged international expert shall completely prepare and deliver the whole two-day workshop on management of illicit assets, which will be held in the premises of the newly established Department for Seized and Confiscated Assets of the Property Directorate, on 14-15 December 2017

Background:

The fight against corruption is an important part of the Government’s Action Plan for Chapter 23 and remains high on the Government’s list of stated priorities. Despite some progress in defining the legislative framework and institutional building, the track record, both on successful investigations and convictions (in particular in senior-level corruption cases), and on prevention of corruption remains limited. Therefore, Montenegro needs to increase the capacity to carry out financial investigations and establish track records of seizure and confiscation of criminal assets.. The Mission was supporting the Property Directorate to implement the Law on Seizure since 2012. This included helping to formulate secondary legislation, providing training, and conducting study visits. In 2015, a new legal framework on seized assets was adopted, including the Law on Seizure and Confiscation of Material Benefit Derived from Criminal Activities. Given the new Law on Seizure and the newly-established Department for Management of Seized and Confiscated Assets, the Mission will continue to contribute to building professional capacity through organization of tailor-made workshops aimed at implementation of the new law and secondary legislation, but through facilitating exchange of experiences with peer organizations in the region. Most of the staff has no experience in managing seized and confiscated assets. Upon request of the new department head, the Mission continued to provide expert assistance to increase the professional capacities of the new staff and improve their everyday work in managing temporarily and permanently seized illicit assets.

Objective:

In the lights of above, the Rule of Law and Human Rights Programme requires the services of the expert on management of seized illicit assets who will completely prepare and deliver the whole two-day workshop on management of illicit assets, which will be held in the premises of the newly established Department for Seized and Confiscated Assets of the Property Directorate, on 14-15 December 2017. The main topics that will be covered through these two-day workshop will be: international legal framework for temporary seizure and confiscation of illicit assets, international cooperation of agencies for management of seized and confiscated assets, seizure under the international requests, membership in regional and international bodies and networks in charge for seizure and management over the seized assets.

Deliverables: Prepared and deliver two day workshop on the following topics:

- regional and international legal framework for temporary seizure and confiscation of illicit assets,

- regional and international cooperation of agencies for management of seized and confiscated assets,

 - seizure under the international requests with use of available legal tools;

 - membership in regional and international bodies and networks in charge for seizure and management over the seized assets -

 All necessary presentations, exercises and other relevant training materials prepared at least two days before the beginning of the training.

     
Mission Specific Requirements    
     
   

 More specifically, the expert will be expected to:

Prepare and deliver two day workshop within which he will present and discuss on following topics:

- international legal framework for temporary seizure and confiscation of illicit assets, with special emphasis for real estate, assets of enterprises and other types of movable property located in the region and other EU countries,

- seizure under the international requests, use of tools for facilitating international cooperation such as databases, information exchanges, etc.;

 - international cooperation of agencies for management of seized and confiscated assets with emphasis on regional aspect of cooperation in SEE countries;

 - membership in regional and international bodies and networks in charge for seizure and management over the seized assets

 - prepare relevant practical case exercises related to the above topics - motivate participants to be actively involved in all training sessions and share their professional experiences, exchange ideas and best practices;

-Discuss with Property Directorate staff all issues related to these two topics, but also other topics related to the issue of management of seized illicit assets

     
Tasks and Responsibilities    
     
   
  • Advanced university degree in law, criminal justice, or related fields;
  • At least 10 years of experience dealing with the management of temporarily and permanently seized illicit assets;
  •  Excellent analytical and writing skills;
  • Demonstrated commitment to sharing expertise and experience in order to develop the capacities of others;
  • Experience in the region is a considerable asset;
  • Local language skills.
