Background  

The Law on Use of Languages  provides for equal status of the Albanian and Serbian as official languages in Kosovo. The OSCE Mission in Kosovo has continuously advocated for the implementation of this Law, including with a focus on bilingual legislation. The Mission’s advocacy to improving the bilingual legislation consisted of different activities conducted in co-ordination with relevant stakeholders, including issuing a Report on bilingual legislation , in 2018, with clear identification of challenges in drafting bilingual legislation and recommendations on how to address them. The Mission aims to further its efforts for improving bilingualism through developing of guidelines on uniform bilingual legislative drafting, which will guide the Government legislative drafting with a focus on bilingualism. To support the process, the Mission requires services of one international consultant.

Objective

The objective of the consultancy is to work with interlocutors in the Office of the Language Commissioner, the Legal Office of the Office of the Prime Minister, and the Ministry of Justice, to develop a set of draft guidelines that will guide ministries in the process of efficiently, effectively, and simultaneously drafting bilingual legislation so that the draft versions in the two official languages are equivalent.

The duration of consultancy is forty (40) working days

Tasks and Responsibilities  

Under the supervision of, and in co-ordination with the Project Manager, the consultant will:

  • Assess the current process of legislation drafting and develop a set of draft guidelines that will guide ministries in drafting legislation simultaneously in Serbian and Albanian versions.
  • Organise a workshop either online or in person with interlocutors to discuss and finalize draft guidelines for drafting legislation

Deliverables:

  • A brief review of the process on law drafting in Kosovo. This review (3-5 pages in length) should describe the drafting process, and the specific verifications on draft legislation, as described in (e.g.) the OECD Checklist on Law Drafting and Regulatory Management in Central and Eastern Europe.  [By 01 November 2020]
  • A set of draft guidelines that the ministries can use as a process map in drafting legislation simultaneously in Serbian and Albanian versions. [By 15 December 2020]
  • These guidelines should be scalable for ministries with greater or lesser resources. 

Performance Indicators:

  • Legislative drafting process is reviewed and summarized in a note;
  • Draft Guidelines are prepared on time, in the agreed form and of satisfactory quality to the Chief of LJS as well as the Government;
  • One workshop either online or in person with the interlocutors is organized and draft guidelines for drafting legislation are finalized.

Necessary Qualifications  

  • University degree in law, human rights, international studies or other related field;
  • At least five (5) years of relevant work experience in drafting or reviewing bilingual legislation;
  • A minimum two (2) years of experience in facilitation of meetings and/or trainings;
  • Knowledge of the Kosovo legal framework;
  • Excellent oral and written communication skills in English;
  • Ability and willingness to work as a member of a team, with people of different cultural and religious backgrounds, different gender, and diverse political views, while maintaining impartiality and objectivity; and,
  • Ability to link Human Rights international standards to Kosovo-specific laws, treaties and secondary legislation.
  • Previous working experience in an international organization is an asset;
  • Previous working experience in the region is an asset.

Remuneration Package  

Remuneration will depend on the qualifications and experience of individual experts as well as the detailed work plan to be agreed upon and will be based on the current OSCE consultancy rates.
