International consultant to develop a policy paper for the Albanian State Labour Inspectorate to monitor, report children’s work, with a focus on the prevention of child labour and protection of children at risk

Background:
In compliance with its Mandate, the OSCE Presence in Albania supports the Albanian Government and the civil society in the fight against human trafficking, including efforts against child trafficking and various forms of exploitation. To address the complexity of children’s economic exploitation in a systematic and holistic approach, in 2017 – 2018, the Presence provided technical expertise to the Ministry of Health and Social Protection for the development of a National Action Plan for the Protection of Children from Economic Exploitation, including children in street situations; and a by-law on the Identification and Referral of Children in Economic Exploitation. Through Extra-Budgetary support from the Italian Government, the Presence will provide continuous support to the child protection structures towards the proper implementation of the National Action Plans and relevant legislation that address child trafficking and economic exploitation.
In order to support the above, the OSCE Presence in Albania is seeking one international and one national consultant to draft a policy paper that will guide the Albanian State Labour Inspectorate in monitoring, collecting data and providing analytical reports on children’s work in Albania.
Tasks and responsibilities:
Based on desk research of the relevant international legislation, the Albanian legislation overview provided by the national consultant and consultations with the Project Manager, the international consultant will develop a policy paper for the Albanian State Labour Inspectorate to enhance the methodology to monitor and report children’s work. The policy paper shall provide guidelines and recommendations for the labour inspectors, covering the following topics:
• Planning and implementing the inspection of children’s work based on the international legal framework and international best practices that can be adapted to the Albanian legislation and institutional frameworks; i.e the labour inspection system, the child protection framework the National Referral Mechanism for victims and potential victims of trafficking;
• The inspection tools to identify working children, with a focus on detecting children who work against the provisions of the Albanian Labour Code and other legal and sub legal acts; Recommended actions for labour inspectors to identify cases and/or prevent children’s exploitation and/or trafficking;
• Data collection and reporting tools for the Labour Inspectors that can generate sex-disaggregated data; forms of labour law violations; undertaken actions for prevention and referral for assistance.
• The format and content of a statistical report for labour inspectors to collect and report quantitative data on children’s work, disaggregated according to the international legal framework pertaining to children’s work conditions, types of work, age, gender.
Deliverables:
• A draft report (policy paper) in English language between 30 to 35 pages, in the format Times New Roman, font size 12;
• Participate in 5 to 6 video calls with the Project Manager and/or the national consultant;
• Reflect the OSCE Presence input and suggestions in the final draft;
• Present the policy paper in a workshop in Albania, to be organized by the OSCE Presence.
Necessary Qualifications
• Higher education in Law, Political Sciences, Social Sciences, Economics, International Development or other related fields;
• A minimum of eight (8) years of work experience as researcher, consultant, specialist in policies addressing the inspection of children’s work;
• Very good knowledge of the children’s work monitoring and child protection systems; monitoring and inspection systems;
• Excellent analytical and writing skills;
• Excellent communication and presentation skills in English;
• Previous similar working experience in the region, preferably in Albania is desirable;
• Knowledge of the OSCE anti-trafficking commitments will be an added advantage;
• Fully-computer literate
Remuneration
The payment for this consultancy will be 4,000 Euros, payable upon submission of the deliverables and their approval by the Project Manager.
