Background
The Office for Democratic Institutions and Human Rights (ODIHR) is seeking an experienced consultant to undertake the design and drafting of a “Model Guidance on Individual Needs Assessment (INA) for Hate Crime Victims” for the Enhancing Stakeholder Awareness and Resources on Hate Crime Victim Support (EStAR) Project.
ODIHR is the principal institution of the OSCE responsible for the human dimension of security. It is active throughout the OSCE area in the fields of election observation, democratic development, human rights, tolerance and non-discrimination, and rule of law.
The Enhancing Stakeholder Awareness and Resources on Hate Crime Victim Support (EStAR) is a two-year project, implemented between 1 January 2020 and 31 December 2021, and financed by the European Commission and the German Government. The project is implemented by the OSCE/ODIHR and VBRG - Association of Counseling Centers for Victims of Right-wing, Racist and Anti-Semitic Violence in Germany across 41 OSCE participating States.

The project has a victim-centered approach, and produces tools for improving protection and services for hate crimes victims and build capacity of service providers.
One of the practical tools to be developed by the EStAR project is a Model Guidance on Individual Needs Assessment (INA) for Hate Crime Victims report (The Report). The Report will be used as a guide to the practical implementation of the requirements outlined in Article 22 of the EU Directive of the 25 October 2012, establishing minimum standards on the rights, support and protection of victims of crime, further referred to as the Victims’ Directive. Article 22 of the Victims’ Directive, entitled “individual assessment of victims to identify specific protection needs” highlights the need for an individual assessment to identify specific needs of each victim. Tasks and Responsibilities
Scope of assignment and methodology
One of the main objectives of the Victims’ Directive is to ensure victims’ particular support needs are addressed, and this is to be achieved by way of an individual assessment and a participatory approach towards the provision of information, support, protection and procedural rights. The purpose of individual assessment is to determine whether a victim is particularly vulnerable to secondary and repeat victimisation, to intimidation and to retaliation during criminal proceedings. The Directive is clear that there needs to be a case-by-case approach towards victims, without creating priority categories or a hierarchy of victims.
The EStAR project is dedicated to developing tools to build the capacity of criminal justice system representatives and victim support actors to better protect, engage and support hate crime victims. The Report will offer guidance for law enforcement agencies as well as civil society organizations providing services to hate crime victims to effectively carry out INA to ensure that hate crime victims have access to support and protection measures.
To this end, the EStAR project requires the services of an experienced expert to draft the Report. The Report will provide a general overview of different ways how assessments are done in project countries, examine effectiveness of existing measures, provide examples of good practices, outline requirements for setting up an effective INA and referral mechanism, suggest measures to address specific protection needs of hate crime victims, and include guides, protocols, questionnaires, etc.
Methodology to be used for the Report:
All activities carried out by the consultant will take into full consideration the confidentiality of all persons and their data.
Deliverables & indicative work plan
Under the supervision of the ODIHR EStAR Project Officer, the Consultant should submit the following deliverables in accordance with the agreed timeline. ODIHR will review the quality of the deliverables submitted and request any improvements necessary to reach the professional standards required.

Remuneration will depend on the selected consultant’s qualifications and experience and be in accordance with OSCE established rates.
