Background

The Office for Democratic Institutions and Human Rights (ODIHR) is seeking an experienced consultant to undertake the design and drafting of a “Model Guidance on Sensitive and Respectful Treatment of Hate Crime Victims in the Criminal Justice System” for the Enhancing Stakeholder Awareness and Resources on Hate Crime Victim Support (EStAR) Project.

ODIHR is the principal institution of the OSCE responsible for the human dimension of security. It is active throughout the OSCE area in the fields of election observation, democratic development, human rights, tolerance and non-discrimination, and rule of law.

The Enhancing Stakeholder Awareness and Resources on Hate Crime Victim Support (EStAR) is a two-year project, implemented between 1 January 2020 and 31 December 2021, and financed by the European Commission and the German Government. The project is implemented by the OSCE/ODIHR and VBRG - Association of Counseling Centers for Victims of Right-wing, Racist and Anti-Semitic Violence in Germany across 41 OSCE participating States.

The project aims to:

  • set up and use a network of hate crime victim specialists from both government and civil society;
  • improve the treatment of hate crime victims by criminal justice system bodies;
  • improve structures available for supporting victims of hate crimes – particularly through strengthened integration of civil society.

The project has a victim-centered approach, and produces tools for improving protection and services for hate crimes victims and build capacity of service providers. 

One of the project tools to be produced is the Model Guidance on sensitive and respectful treatment of hate crime victims in the criminal justice system. The Model Guidance will be a practical resource for the EStAR project countries to strengthen the ability of the national criminal justice system agencies – namely, the police, prosecutor’s offices, and the judiciary – to ensure sensitive and respectful treatment of hate crime victims in the criminal justice system.

 

Tasks and Responsibilities

 

Scope of assignment and methodology

The Model Guidance on Sensitive and Respectful Treatment of Hate Crime Victims in the Criminal Justice System will provide the context for a hate crime victim as a specific category of victims and their status for the purpose of accessing protection and support services, as well as participating in the criminal justice procedures; needs of hate crime victims, and challenges faced by the hate crime victims in the criminal justice system.

It will also outline necessary steps for ensuring effective government response to establish and enact policy and practice of sensitive treatment. Primarily, the Model Guide will provide practical recommendations to the national authorities within the criminal justice system - the police, prosecutors and the judiciary - on how best to interact and treat hate crime victims. Additionally, hate crime victim support providers, both state and non-state representatives, would be able to benefit from the use of the Guidance. Recommendations should be framed by the rights of victims in the criminal proceedings, as outlined by the EU Victims’ Rights Directive.[1]

The Model Guidance on Sensitive and Respectful Treatment draws on the information collected during the mapping for the EStAR Baseline report on the State of Play of Support Structures and Specialist Services for Hate Crime Victims, along with additional consultations and research as needed. It also builds on the ODIHR’s and VBRG’s previous work, as consolidated in the following publications: the EStAR Understanding the Needs of Hate Crime Victims (EStAR Victims’ Needs Paper), the ODIHR Hate Crime Victims in the Criminal Justice System:  A Practical Guide (Victims Guide) and the VBRG Hate Crime Victim Support in Europe – A Practical Guide (VBRG Guide). It will be published in hard-copy, as well as online and disseminated amongst the EStAR Expert Network members and partners.

The Model Guidance is designed to:

  • Support government officials policy makers and support providers in their efforts to strengthen the policy frameworks and practices for sensitive and respectful treatment of hate crime victims in the criminal justice system;
  • Build the capacity of criminal justice professions to engage with and assist hate crime victims in a sensitive and respectful manner;
  • Promote dialogue and co-operation between local law-enforcement officials, civil society and community-based organizations, and members of targeted communities;
  • Facilitate the sharing of best practices from various EStAR project countries;
  • Support civil society advocacy efforts by providing guidance on the relevant measures and mechanisms that states should have in place to meet their obligations on hate crime victim support.

All activities carried out by the consultant will take into full consideration the confidentiality of all persons and their data.

Deliverables & indicative work plan

Under the supervision of the ODIHR EStAR Project Officer, the Consultant should submit the following deliverables in accordance with the agreed timeline. ODIHR will review the quality of the deliverables submitted, and request any improvements necessary to reach the professional standards required.

Necessary Qualifications, Experience and Skills:

  • Advanced University degree in relevant subject e.g. law, political science, social science, human rights or related fields,
  • At least 5 years of experience in hate crime victim support and/or experience working with hate crime victims in the criminal justice system, 
  • Solid knowledge of international and European standards in relation to victims’ rights,
  • Demonstrated knowledge and awareness of gender and diversity issues, and proven ability to integrate gender and diversity perspectives into the products and projects,
  • Professional knowledge of English, including previous experience in drafting publications in English,
  • Excellent usage of Microsoft applications, including the ability to independently finalize a document for external use.

Remuneration

Remuneration will depend on the selected consultant’s qualifications and experience and be in accordance with OSCE established rates.

Consultancy period: October – November 2020.
