Background
     
   

The OSCE Office for Democratic Institutions and Human Rights (ODIHR) is seeking an experienced consultant to draft a policy paper on existing practices and shortcomings in hate crime victim support, as well as recommendations for specialist support provision to victims for the Enhancing Stakeholder Awareness and Resources on Hate Crime Victim Support (EStAR) Project.

 

ODIHR is the principal institution of the OSCE responsible for the human dimension of security. It is active throughout the OSCE area in the fields of election observation, democratic development, human rights, tolerance and non-discrimination, and rule of law.

 

The Enhancing Stakeholder Awareness and Resources on Hate Crime Victim Support project (EStAR) is a two-year project, implemented between 1 January 2020 and 31 December 2021, and supported by Extra-budgetary contributions from the European Commission and the German Government. The project is implemented by ODIHR and VBRG, (Association of Counseling Centers for Victims of Right-wing, Racist and Anti-Semitic Violence in Germany) across 41 OSCE participating States.

 

The project aims to:

 

  • Increase awareness of national stakeholders on hate crime victims' rights and needs, of OSCE/EU commitments, standards and good practices in hate crime victim support;
  • Collaborate with hate crime victim specialists from both government and civil society in the development of a broader range of tools and resources for national criminal justice system practitioners’, institutions, government and civil society victim support organizations;
  • Facilitate effective protection and improve specialist support systems for hate crime victims in criminal proceedings through the promotion of government and civil society collaboration.

 

The project takes a victim-centered and gender-mainstreamed approach, and produces tools for improving protection and services for hate crimes victims and to build capacity of service providers. 

     
Tasks and Responsibilities
     
   

Objective

 

EStAR’s policy paper on existing practices in hate crime victim support, shortcomings and recommendations will provide an up-to-date characterization of the state of specialist support provision to victims of hate crime in the OSCE region. The objectives of the policy paper are to:

 

  • Provide policy recommendations for the establishment, improvement or expansion of high-quality specialist hate crime victim support;
  • Contribute to a better understanding of the unique nature of impact hate crimes have on individuals and communities to inform the formulation of policy in support of specialized service provision;
  • Promote dialogue and co-operation between local law enforcement officials, civil society and community-based organizations, and members of targeted communities;
  • Promote increased co-operation and effective communication among service providers, with professionals of different associated disciplines, affected communities, and the law enforcement and judicial authorities;
  • Facilitate the sharing of best practices from various EStAR project countries. 

 

Scope of assignment and methodology


The policy paper will lay out how specialist hate crime victim support forms a crucial part of an effective counter-hate crime strategy. The paper will therefore:

 

  • Outline the characteristics of an effective delivery of services provided by specialized support organizations (e.g. holistic approach to the distinct needs of hate crime victims, pro-active outreach to victims, targeted local interventions);
  • Emphasize the importance of adopting and abiding by quality standards in the provision of support services;
  • Demonstrate how specialist support services not only assist victims in their efforts to recover and regain agency, but also contribute to awareness-raising in the general public of the damaging effects of hate crimes on societies;
  • Show how the work of specialist support services synergize with efforts of the law enforcement and criminal justice sector to improve their response to the needs of hate crime victims system;
  • Illustrate how access to adequate support plays a vital role in ensuring access to justice for victims of hate crime and in fighting impunity of perpetrators.

 

The policy paper is aimed at:

 

  • Policy advisers, i.e. policy researchers and policy analysts, policy- and decision-makers responsible for designing/improving services for victims of crime, and hate crime in particular;
  • Both general and hate crime specific victim support practitioners working with Criminal Justice System (CJS) and Civil Society Organizations (CSOs) specialist support services;
  • Community and non-governmental organizations (NGOs) working on human rights, inclusion, diversity issues.


The EStAR project aims to be inclusive and reflect needs and experiences of all members of society in its tools and resources. Therefore, this policy paper takes a gender-sensitive approach and, where applicable, incorporates experiences and needs of each individual. This is to ensure the paper itself, and the examples it includes, captures realities of individuals not by focusing on one protected characteristic, but in combination with others, for example gender is not addressed as an isolated category of identification but intersected with protected characteristics such as ethnicity, religion or belief, race, age, legal status, disability, etc. This approach captures the multidimensionality of people’s experiences and identities thus reaffirming a victim-centered approach to hate crime victim support.

 

Deliverables & indicative work plan

 

Under the supervision of the ODIHR EStAR Project Officer, the Consultant should submit the following deliverables in accordance with the agreed timeline. ODIHR will review the quality of the deliverables submitted in timely fashion and request any improvements necessary to reach the professional standards required.

 
Main activities / Working days

 

  1. Meeting to discuss concept, structure and methodology of the policy paper, and agree on an indicative timeline with deliverable dates - 0.25 day
  2. Conduct a targeted literature review of specialist victim support policy documents and identify elements of the problem, gather evidence to demonstrate the impact of not addressing the problem, offer options for addressing the problem - 3 days
  3. Create semi-structured interview questions and conduct interviews with specialist support providers within and outside the EStAR network and beneficiaries of specialist support services to inform formulation of core elements of the policy paper- 3 days
  4. Compile and present good practices from the OSCE pSs of specialist support services providers fulfilling a unique role in supporting individual victims and communities - 1 day
  5. Submit a framework outlining the rationale for action on the problem, proposed policy option/s and policy recommendations. Prepare an outline for the policy paper, consisting of a table of contents (without sub-headings) and indication for content to be included in each section - 2 days
  6. Go over EStAR team’s inputs and feedback, agree on adjustments and next steps - 0.5
  7. Prepare First Draft of the policy paper - 6 days
  8. Go over EStAR team’s inputs and feedback, agree on adjustments and next steps - 0.25 day
  9. Submit Second Draft for selected EStAR Expert Network Review - 2 days
  10. Review inputs and feedback by EStAR team and EStAR experts, agree on adjustments - 0.5 day
  11. Finalize the policy paper, including by addressing any editorial and formatting issues, ensuring functionality of the links in the Bibliography section and throughout the document, and addressing any other outstanding issues.
  12. Submit Final Draft - 1.5 days

Total: 20 days

 

     
Necessary Qualifications
     
   
  • Advanced University degree in a relevant subject area e.g. law, social science, human rights or related fields;
  • Minimum of 6 years’ experience conducting research and drafting documents and reports for  publications with an emphasis on hate crimes, victim support, discrimination, and other related fields;
  • Knowledge of international and European standards in relation to victims’ rights;
  • Demonstrated knowledge and commitment to values of gender, diversity and inclusion and proven ability to integrate these perspectives into projects and products;
  • Excellent knowledge of English, including previous experience of drafting publications to a very high standard in English;
  • Excellent usage of Microsoft applications, including the ability to independently finalize a document for external use.

Remuneration Package
     
   

Remuneration will depend on the selected consultant’s qualifications and experience and be in accordance with OSCE established rates.
