Background    
     
   

This vacancy is open only for the applicants with the citizenship of or permanent residence in the Republic of Serbia.

Aiming to respond to the new challenges, including the impact of digitalization on data privacy, the Parliament of the Republic of Serbia adopted the new Law on Personal Data Protection (the Law) in November 2018.The implementation of the Law began in August 2019 with a view to make it possible for all the actors to adapt to the latest legal requirements.  The Law incorporates the provisions of the General Data Protection Regulation of the EU (GDPR), which prescribe the way in which personal data may be processed and provide for the rights of data subjects (any person whose personal data is being collected, held or processed). It also includes provisions concerning the obligations of all entities processing personal data (data controllers and data processors), as well as the Directive pertaining to data protection in cases of personal data processing for the purposes of the prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties (known as the Data Protection Law Enforcement Directive). Furthermore, the Republic of Serbia recently signed the Protocol amending the Convention for the Protection of Individuals with regard to Processing of Personal Data (known as the Convention 108+).

Collecting, processing and storing personal data is among the core activities of the authorities engaged in the prevention and prosecution of criminal and other offences. Therefore, the Mission will assist the Commissioner’s Office and public authorities in the implementation of the Law by commissioning an analysis of the security sector related legislation from the perspective of personal data protection.

The analysis will provide a detailed overview of the competencies of the law enforcement authorities, as well as other authorities in the security sector, with regard to the processing of personal data.  It will also include an assessment of the current framework for democratic control of personal data processing without the consent of the data subject for the purpose of prevention and prosecution of criminal and other offenses. Finally, the analysis should provide recommendations in case there is a need to improve personal data protection regulatory framework.

To this end, the Mission requires the services of two experts in the field of personal data protection to conduct an analysis of the security sector related legislation, prepare a report based on the analysis and findings, issue specific recommendations for possible interventions, and present the report to relevant stakeholders and the public.

     
Tasks and Responsibilities    
     
   

Under the supervision of the National Project Officer and in co-ordination with the Commissioner’s Office, the consultant will be responsible for:

  1. Providing a methodology for conducting in-depth analysis of the existing legislation governing security sector from the perspective of personal data protection, including the law and by-laws, strategies and other relevant documents;
  2. Preparing a work plan;
  3. Assessing the compliance of the aforementioned documents with the Law on Personal Data Protection of the Republic of Serbia and the European Union’s data protection regulation;
  4. Conducting desk research, reviewing the official documents (laws, by-laws, strategic documents and other available sources on the matter) and collecting relevant information through other sources as appropriate;
  5. Liaising with the representatives of the national institutions of the Republic of Serbia (personal data protection/free access to information institutions and other competent national institutions), if appropriate;
  6. Analysing the current framework for democratic control of the personal data processing without the consent of the data subject, for the purpose of prevention and prosecution of criminal and other offenses;
  7. Preparing a report (in Serbian) with recommendations based on the findings, and presenting it to the public.

The consultant will work from home, except for the public event presenting and discussing the summaries of lessons that will be held at a location in Belgrade. 

The two selected consultants will carry out these tasks in co-operation. Prior to performing their tasks, the experts will jointly develop a methodology for conducting the analysis and a work plan, and share these with the OSCE Project Manager.

     
Necessary Qualifications    
     
   
  • Citizenship of or permanent residence in the Republic of Serbia;
  • Advanced university degree in law;
  • Minimum 5 years of professional work experience in the field of personal data protection;
  • Established knowledge and understanding of the legal and strategic framework of the security sector in the Republic of Serbia;
  • Established in-depth knowledge of the legal framework of the personal data protection in the Republic of Serbia, and of the European data protection regulatory framework (EU and Council of Europe);
  • Proven ability to conduct desk research and analysis, and strong analytical, reporting and writing skills;
  • Excellent interpersonal, communication and presentation skills, and openness to receive and integrate feedback;
  • Ability to work under pressure and in stressful situations;
  • Professional fluency in Serbian and English language, both oral and written;
  • Computer literate with practical experience in Microsoft packages;
  • Ability and willingness to work with people of different cultural, national and religious backgrounds;
  • Demonstrated gender awareness and sensitivity, as well as the ability to integrate a gender perspective into tasks and activities.

Remuneration Package    
     
    The consultants will be employed on a Special Service Agreement covering a total period of two months, starting approx. in July 2020, and will be paid a total amount not exceeding RSD 424,000 in total, commensurate to individual qualifications and experience.
