| Background | ||
|
Participation of the public in environmentally significant decision-making and access to environmental information are mandatory according to a number of regulatory and legislative acts of the Kyrgyz Republic. However, the prevalence of conflicts and low public participation are primarily due to a lack of effective mechanisms for public involvement, and a paucity of local bylaws regulating the impact of public opinion on decision-making processes. Inadequate public participation methods are also a problem for decision-makers who do not have the capacity to organize and hold preliminary consultations and systemize their results for making well-balanced decisions. Indeed, the area of environmental regulation has the most limited compliance in the Kyrgyz Republic, as it is linked with low public awareness and insufficient capacity of law enforcement and judicial system representatives who are mostly unaware of environmental law and environmental processes, at least not enough to render decisions and procedures according to the existing national legislation and international commitments of the country.
