Background  

The Mission’s mandate, given by the Permanent Council Decision 305 of 01.07.1999 with reference to United Nations Security Council Resolution 1244 gives the Mission a “leading role in matters relating to institution- and democracy building and human rights.” This includes the monitoring of justice system institutions for compliance with the principles of rule of law and human rights.

To this end, the Rule of Law portfolio of the Law and Justice Section within the Mission’s Department of Human Rights and Communities monitors trials to help the justice system upgrade their practices. Specifically, the monitoring helps to guarantee fair trial rights regardless of gender and ethnicity, to ensure an effective enforcement of decisions on inter-ethnic cases and those committed predominantly against certain categories of society (including crimes committed because of intolerance, prejudice or hatred), and to support the integration of the justice sector pursuant to the agreement on normalization of relations.

The Mission’s findings from court monitoring are regularly shared with representatives of the Justice Sector in Kosovo so as to improve functionality and compliance with best practices and human rights standards.

The seven Basic Courts and 20 Branch Courts throughout Kosovo have, in 2018, handled in total 375.151 cases (criminal, civil, administrative, commercial, minor offences), whereas Serious Crimes Departments of Basic Courts, which primarily handle cases which are monitored as the Section’s priorities, have processed 5431 cases.  During this time, the Mission monitored 1,175 of these court cases, which involved trial monitor presence in 2,162 hearings. In other words, the Mission in 2018 has monitored 22 % of cases handled by Serious Crimes Departments. The Mission believes that this level of monitoring allows for sufficient coverage, both thematically and geographically, in order to give maximum validity to its assessments on the course, content, and character of issues in trials. While this coverage is statistically significant, the Mission will always strive to work more efficiently, and aim at constantly improving the quality of its work. To this end, the Mission wishes to evaluate its own performance.

Scope of the evaluation

OMiK is seeking to hire an evaluation expert to assess the relevance, impact, efficiency, and effectiveness of its work in trial monitoring/rule of law portfolio from programmatic and organisational point of view.

The evaluation will focus on the following questions:

1.  Programme results, relevance, and the future

  • Results: the extent to which the programme has achieved its expected results and how (outputs and contributions to outcomes)? What factors account for these results? Were there any anticipated results? What was not achieved and why?
  • Relevance: Were the project/portfolio activities including the methodology of case selection, results and objective relevant in addressing the problems that the initiative identified?
  • Strengths and weaknesses: what programmatic strengths and weaknesses emerge from the analysis of the rule of law portfolio activities/projects?
  • Future programming: where could OMiK provide a meaningful contribution to support further the area of trial monitoring/rule of law portfolio, considering also other international actors in this area? 

2.  Programme Management:

  • How effective was the management of the programme overall? How effective was the programme monitoring at different levels? To what extent was monitoring undertaken and used to improve programme design and implementation?
  • How effective was the programme in terms of resources invested and outcome?

3. Lessons learned and recommendations:

  • What lessons can be drawn that could be of value to OMiK’s further programing in this field?

Evaluation methodology

The evaluator will be selected based on the proposed evaluation methodology. The methodology will be then finalised in detail at the beginning of the contract based on feedback by OMiK. The evaluation will ensure that key stakeholders will be consulted. The evaluation will involve the following:

  • Desk review of all relevant documents of the programme
  • Interviews and/or group discussions with stakeholders and partners
  • Field visits across Kosovo.

The duration of consultancy is twenty (20) working days  

Tasks and Responsibilities  

Under the overall supervision of the Head of the Office of Central Coordination (OCC) and in close co-operation with the Chief of the Law and Justice Section (LJS), the consultant will be expected to perform the following duties:

 

  • To conduct interviews with relevant interlocutors and counterparts across Kosovo
  • To identify specific examples of similarly situated regional programming to use as a baseline comparator with OMiK trial monitoring
  • To measure the impact of the project/portfolio implemented activities, based on relevance, efficiency, effectiveness, impact and sustainability of its results, including impact on gender
  • To identify progress so far, the strengths and weaknesses of programming; and
  • To formulate recommendations for future programming, including potential activities and proposals for changes, if any, to be designed/implemented in the near- to mid-term

Key Deliverables

  • Within 5 days of contract signature, to submit a detailed evaluation work-plan with clear timelines and related deliverables and evaluation methodology including questions listed herein
  • Within 45 days of contract signature, to deliver a draft report to the Chief of LJS and OCC
  • Within 60 days of contract signature to submit the final evaluation report, taking into account feedback given by OMiK. The final evaluation report will be written in English (maximum 35 pages, not including Annexes), with an executive summary of maximum 1 page.

The draft and final reports should be written full in line with OMiK’s writing and reporting standards. The structure of the reports should include, as a minimum, the following

  • Table of Contents
  • Executive summary
  • Methodology
  • Analysis and findings
  • Lessons learned
  • Recommendations
  • Annexes (including interviews list, data collection instruments, key documents consulted)

 Necessary Qualifications  

  • University degree in law
  • At least 10 years of experience of working in the rule of law area, specifically in trial and/or case monitoring
  • At least 5 years prior experience as judge, prosecutor or lawyer
  • Proven expertise and track record in evaluating rule of law related projects and qualifications around the specific thematic issues under evaluation
  • Experience in producing high quality evaluation reports, including recommendations for future work of the organization
  • Familiarity with issues pertaining to trial monitoring in Kosovo or in the region would be considered as an asset
  • Excellent writing and reporting skills
  • Fluent in written and oral English language

Remuneration Package  

Remuneration will depend on the qualifications and experience of individual experts as well as the detailed work plan to be agreed upon and will be based on the current OSCE consultancy rates.
