Background:

The Presence seeks to assess and improve the length of court proceedings in Albania. In the context of the Justice Without Delays Project, the Presence will prepare a study containing statistical information and analysis on the length of the proceedings and causes of postponements in the Albanian district courts. This study will also provide good examples from the courts which have reached progress in efficiency of court proceedings, will analyse the data, draw conclusions and recommend improvements or follow up actions when necessary. As part of the study, one local legal expert will be hired to prepare a legal analysis and interpretation of the Presence’s Nation-wide Courts Statistics.

Objective: The Presence’s Rule of Law and Human Rights Department seeks for a local legal expert highly knowledgeable in court proceedings to prepare a Legal Analysis and Interpretation of the nation-wide court statistics on length and productivity in the courts collected by the Presence.

 

Tasks and responsibilities:

The consultant under the guidance of the Presence’s point of contact will be expected to:

1- Participate in a preparatory co-ordination meeting with the Presence’s point of contact to discuss about the content of the Analysis and obtain the Presence’s reports, which will serve the Analysis. In conclusion of the meeting, minutes of the meeting will be submitted to the expert by email.  2- Based on what concluded with the Presence, the expert will prepare a Legal Analysis which will consist of: a. An analysis and interpretation of statistical information contained in the Presence’s Nation-wide Courts Statistical b. Summary of measures taken by the courts to reduce delays of proceedings resulting from the Presence’s reports and other project documents; c. Appropriate recommendations for the less productive courts in order to take up improvements. d. The report shall be prepared in the Albanian language. e. The report will be submitted in a Word format and contain no more than 50 pages.   

Expected Output/Deliverable:

• Deliver to the Presence a complete Draft Analysis of all mentioned above in a unified document in Albanian by 30 August 2019. • Reflect comments provided by the Presence on the draft and submit a final version by 10 September 2019. • Make an oral presentation of the Analysis in a roundtable with justice professionals to be organized by the Presence in September 2019.

 

Training and Education

Master studies in law;

Knowledge and Experience • Experience in conducting legal analysis, assessments or studies on the efficiency or progress of court proceedings in Albania judicial system; • Current or previous experience with the judiciary as a practitioner or supporting staff would be an asset; • Experience in carrying out research or drafting legal reports/opinions or publications related to law. • Excellent communication and drafting skills in Albanian; • Computer literate with practical experience in Microsoft Office applications; • Gender awareness and sensitivity, as well as the ability to integrate gender perspective into tasks and activities;  

Competencies

• Actively contributes to achieving the purpose of the assignment; • Ability to have clear and transparent communication with the project staff and collaborators.

Remuneration

The payment for this consultancy will be 1,500 Euro,payable upon submission of the last above mentioned deliverable, cleared by the point of contact of the OSCE Presence in Albania.
