Background

The OSCE Mission in Kosovo (the OSCE) strives to support responsive and inclusive institutions that address and promote rights of persons belonging to communities. Based on its ad hoc monitoring, the Mission recorded issues with obtaining civil status, civil registration and other documents. Personal documents are a precondition for accessing services in Kosovo and are basis for people’s ability to exercise the rights they are entitled to. The personal documentation issues have been particularly problematic for the most vulnerable communities in Kosovo, including women, displaced persons and returnees, but they affect people belonging to all communities. Some of the issues that have so far resurfaced range from the inability to obtain a document to invalidity of some documents based on either unregulated or inconsistent practices or the lack of comprehensive policy and legislation. However, a full scope of these problems is unknown and the OSCE would like to hire a consultant to conduct a complete mapping of issues, legal analysis of existing legislation and provide recommendations for further action that is required to address the problems.

Objective

The objective of the consultancy is a production of a comprehensive report that includes legal analysis and mapping of the issues pertaining to the personal documents, as well as recommendations for necessary intervention.

The duration of consultancy is 65 working days.

Tasks and Responsibilities

The local consultant will perform the following functions:

Analyse all existing primary and secondary legislation as well as policy documents related to civil status, civil registration and other documents are requested by the OSCE
Conduct desk research of all existing secondary sources pertaining to personal documents issues as provided by the OSCE
Map out compliance with the abovementioned legal and policy framework of central (Civil Registry Agency, Ministry of Internal Affairs) and municipal institutions (Civil Registration Offices, municipalities)
Map out irregularities as well as cases that remain outside of the scope of the existing legal and policy framework
In co-ordination with OSCE, gather information through interviews with institutions and organisations working on personal documents issues
In co-ordination with OSCE, gather information through interviews with persons that are directly affected by the issues with personal documentation
Take particularly into account the most vulnerable persons belonging to communities, including displaced persons, returnees and women, as advised by the OSCE
Compile a final report with all finding and recommendations for further action.

Deliverables

By 1 July 2019, a draft work plan, based on briefing and documents provided by the OSCE
By 26 July 2019, first part of the report containing the full legal analysis as available based on desk research; a part of draft report needs to include analysis that relates to access to personal documents for specifically women
By 2 August 2019, an amended work plan containing detailed overview of interviews to be conducted and a list of all level stakeholders to be interviewed as part of the field research
By 30 August 2019, field research phase and, a progress report with preliminary findings; the findings need to contain a separate chapter on how women are affected by personal documentation issues
By 20 September 2019, a full report outlining finding and recommendations for further action; the final report needs to contain a separate chapter on how women are affected by personal documentation issues.

Key Performance Indicators

All deliverables from section IV implemented and delivered as requested.

Necessary Qualifications

At least first-level (preferably an advanced-level) university degree in law
Minimum five years of working experience in a professional or academic capacity
Excellent research skills: including legal analysis, secondary source analysis, gathering of data through desk research and interviewing, report writing
Excellent spoken and written English language, including drafting skills; professional knowledge of Albanian and Serbian languages is desirable
Advanced computer skills, fully competent use of Microsoft packages;
Knowledge on how to mainstream gender into day-to-day work, including legal analysis, field research and providing recommendations for further targeted intervention;
Knowledge of local legal framework;
Desirable knowledge of Serbian legal framework;
Ability to work with people of different nationalities, religions and cultural backgrounds;
Knowledge on how to mainstream gender into day-to-day work and demonstrated gender sensitivity in interpersonal relations.

Remuneration Package

Remuneration will depend on the qualifications and experience of individual experts as well as the detailed work plan to be agreed upon and will be based on the current OSCE consultancy rates.
