Background  

The OSCE Mission in Kosovo (“OMiK”) through its Law and Justice Section (“LJS”) monitors the justice sector for compliance with human rights standards. It also engages in projects aimed at improving the justice sector. Relevant Kosovo institutions are actively pursuing criminal cases against persons suspected of being involved in violent extremist activities. While OMiK has actively supported the efforts of the Kosovo institutions in fighting terrorism, the rule of law, and the fair and equal administration of justice, requires that justice sector institutions respect and protect human rights. There are two areas in which human rights are particularly susceptible to being abused. The first area pertains to the treatment of terrorism suspects during an investigation and ensuring that proper procedures are followed to protect human rights and ensure a properly obtained conviction for those guilty of terrorism related offenses. The second area where violations occur is when investigations wrongly impinge upon the human rights of people who are not the target of an investigation.

In Kosovo, little training on human rights related to CVE is available, but is of the highest importance for actors dealing with such cases as well as young lawyers freshly stepping into the legal practice to acquire in depth knowledge in this particular field of law. This summer camp will expose newcomers to the legal field to a complex field of specialization to engage with practical concerns in the field.

Objective

This activity will provide basic training to senior students and recent law graduates, on the protection of human rights in CVE cases. The Mission will organise a one-week summer camp training in a location, outside Prishtinë/Pristina. During the camp, future and current young legal professionals will obtain essential knowledge on application of established international human rights standards related to CVE and terrorisms cases. The Mission through an international expert consultant, local experienced professionals and staff members will provide a comprehensive curriculum, and will deliver the training. The goal of the summer camp will be to improve the overall knowledge of young legal professionals on the important topics of VERLT as one of the critical issues the justice system and the society as a whole in Kosovo are currently facing.

The duration of consultancy is fifteen (15) working days between 15 June and 15 July 2019.  

Tasks and Responsibilities     

Under the supervision of and in co-ordination with, the Project Manager and trainers from the Kosovo Academy of Justice the expert will:

  • Develop a curriculum for a five-day summer camp training on human rights concerns in CVE/terrorism cases; and
  • Deliver five-day training
  • Prepare a post-training report

The summer camp training should:

  • Reflect the most recent developments in international law in this area and be relevant to judges, prosecutors, police and defence attorneys working in Kosovo
  • Cover relevant Kosovo law and the interplay between Kosovo law and internationally recognized standards. It will be based on
    • Current training modules on CVE and human rights standards at the Kosovo Academy of Justice and the Kosovo Academy for Public Safety (to be provided by OMiK)
    • The most recent annual reports of the Ombudsperson Institution of Kosovo regarding human rights issues in policing and prosecution; and
    • Other reports of international entities the expert considers to be pertinent, such as OMiK/ODIHR publications
  • The summer camp training should cover both of the following areas
    • Human rights concerns specific to persons being investigated or prosecuted to ensure their rights are not violated
    • Human rights concerns with regards to citizens who are not targets of investigations, e.g. rights to privacy, personal security, and other areas where governments are prone to excesses in investigations.

Deliverables

  • A formal training curriculum suitable for potential future adaptation to current training standards at the Kosovo Academy of Justice and the Kosovo Academy for Public Safety, according to OMiK Writing and Reporting Guide (or such other reasonable standards provided by OMiK), to be submitted by 20 June 2019
  • Condensed written guidelines for participants, according to OMiK Writing and Reporting Guide, submitted by the consultant by 20 June 2019
  • Training for senior students and recent law graduates including PowerPoint slides and notes, to be delivered at a five day event, on 24-28 June 2019
  • Full desk report and post-training report, to be submitted by the consultant according to OMiK Writing and Reporting Guide, no later than 15 July 2019.

Performance Indicators

  • A five-day relevant summer camp training curriculum is prepared to the satisfaction of the OMiK Project Manager
  • Five-day training with senior students and recent law graduates is timely organised and delivered and meets the needs of the participants
  • An informal guide containing relevant information is approved by the OMiK Project Manager, and is distributed  to the participants at the training
  • Full desk report and post-training report delivered on time.
  •  

Necessary Qualifications     

  • University degree in law, human rights, international studies or other related field
  • At least ten (10) years of relevant work experience, specifically in prosecution or defence practice in an adversarial criminal justice system
  • Expertise in the field of human rights as it relates to terrorism cases, their investigation and disposition
  • A minimum three (3) years of experience in training delivery
  • Knowledge of the justice system in Kosovo
  • Excellent oral and written communication skills in English
  • Ability and willingness to work as a member of a team, with people of different cultural and religious backgrounds, different gender, and diverse political views, while maintaining impartiality and objectivity; and,
  • Ability to link current international standards to Kosovo-specific laws, treaties and secondary legislation investigations and prosecutions
  • Previous working experience in an international organization is an asset
  • Previous working experience in the Balkans and Kosovo is an asset.

Remuneration Package  

Remuneration will depend on the qualifications and experience of individual experts as well as the detailed work plan to be agreed upon and will be based on the current OSCE consultancy rates.
