Under the Project "Enhancing the capacities and accountability of the law enforcement agencies" the Mission supports the Montenegrin Government in the further development of the security sector in making it a more democratic, transparent and accountable service for citizens. It has been highlighted in EU reports that little or no progress was reported in regard to cases of Trafficking of Human Beings (THB).This is due partially to a lack of consolidated case-law, the identification and protection of victims of trafficking which remains a persistent concern. Montenegro is recognized as a transit country and to a lesser extent a country of origin and destination for victims of THB. Progress in this area will depend on a multi-sectorial approach and intensive co-operation followed by the implementation of effective measures in prevention, suppression, and the punishment of perpetrators as well as the protection of the victims. Therefore, the Mission has remained focused on this topic in order to support institutional progress. In 2016, the Mission facilitated a number of roundtables which included the component of basic THB training for representatives of national institutions that are signatories of the Memorandum of Co-operation on Fight against THB. These include the police, social welfare services, schools, medical centres, judicial agencies and NGO sector. Additional trainings are planned to be organized for the representatives of the above mentioned institutions, on the subject of the methods of identification of victims, prosecution of cases as well as providing assistance and protection to victims. Objective: The OSCE Mission to Montenegro requires the services of an experienced consultant to assist the National Co-ordination for THB (NCO) within the MoI to enhance the capacity of representatives of various national institutions (signatories of the Memorandum of Co-operation on Fight against THB) identified above. The consultant will work for a period of five (4) days. The consultant will be engaged to work with groups of 10-15 participants within the four Montenegrin municipalities (Berane, Bijelo Polje, Tivat and Podgorica). Deliverables: a) Within ten (10) days on receiving information from the Security Cooperation Program on planned activities the consultants will: - Prepare the timeline for four days of training; - Prepare presentations and case studies that will be specifically devoted to the topics of identification of victims of trafficking in human beings, the prosecution of traffickers, providing material evidence and the crafting of sustainable indictments; - Provide the necessary material to be used during the training by email: b) Within five days of the timeline and the training material being approved by the Security Cooperation Program and NCO, the 4-day training starts. c) Within 5 days after the completion of four days trainings, the expert provides training evaluation reports. The report should be drafted in English language. Location The consultants will conduct trainings in the four Montenegrin municipalities (Berane, Bijelo Polje, Tivat and Podgorica). All travels will be arranged by the OMiM in coordination with National Co-ordination for THB (NCO). |

| Mission Specific Requirements | ||
| The scope of the work performed by the consultants will include the following: a) Facilitate one training course on four separate occasions on the prosecution of human trafficking cases including the methods of identification of victims, prosecution of cases as well as providing assistance and protection to victims. b) Provide participants with the required skills on the prosecution of human trafficking, the identification of victims of trafficking in human beings, the prosecution of traffickers, obtaining material evidence and crafting sustainable indictments. c) Prepare and deliver a post-training evaluation report. | ||
| Tasks and Responsibilities | ||
| - University level diploma from the Faculty of Law - Minimum 6 year experience in the practice of law, e.g. judges, prosecutors, lawyers, etc. (Preferably prosecutors) - Experience in criminal justice and/or law enforcement, prosecution of human trafficking cases, identification of victims, and prosecution of cases, providing assistance and protection to victims. - Proven experience in prosecution of human trafficking cases and outlining any study cases that they were involved in. - Knowledge of international legal procedure standards and instruments - Excellent knowledge of the English language (speaking, writing, reading), knowledge of Montenegrin is a distinct advantage; - Excellent legal analytical, communication, training and presentation skills. | ||
