Background    
     
   

Background:

The results of the survey on citizens’ perception of the mediation, conducted by the Mission in past years, have pointed out the need for intensive promotion of the use of mediation and continuous capacity building of mediators aimed at the protection of citizens and unburdening of courts. As a continuation of its previous practice, and in line with the Mediation Centre training needs assessment and the Rulebook on the training of mediators, the Mission will support the Centre in organization of an intensive four-day training for new group of 20 mediators in civil/family disputes. The training should be done in accordance with the Rulebook on the Training Programme for Mediators, adopted by the Ministry of Justice and Agenda developed by the Mediation Centre of Montenegro, and it should cover the topics such are: definition and types of the Alternative ways for dispute resolution; definition of mediation, its historical development and characteristics; basic principles of mediation, and characteristics of the procedure; who can be a mediator, necessary knowledge and skills; cases acceptable and suitable for mediation; the mediation procedure – its phases and course of mediation; evaluation of achieved knowledge through role play and practical exercises. After the conducted training and successfully passed final test at the end, trainees will be nominated as mediators by the Ministry of Justice and their names will be added to the list of mediators, hold by courts and prosecution offices.

Objective:

 In the lights of above, the Rule of Law and Human Rights Programme requires the services of an experienced international trainer for mediation who, in coordination with two other trainers (one international and one local) and in close cooperation with the Mediation Centre and the Mission, will prepare and deliver intensive four-day basic training on mediation for a group of 20 new mediators, which will be held from 30 October to 2 November 2007.In that light the engaged trainer should prepare necessary presentations – related to the general topics such are: basic principles of mediation, and characteristics of the procedure; who can be a mediator, necessary knowledge and skills; cases acceptable and suitable for mediation, etc.. He/she should also prepare practical exercises related to the mediation process phases (first stage: introduction to the mediation process, agreement on the mediation process rules and principles; establishing the trust among parties and mediator, etc.;, second phase: how to pose a question; reframing; skills to identify the positions, attitudes and motives of parties in the process; skills to find the solution of the problem; development of the agreement, etc.). Engaged expert, jointly with two other trainers, shall also prepare role play exercises in order to evaluate achieved knowledge of trainees and propose the list of candidates for possible future mediators.

Deliverables:                    

                                                                                                        

  • All necessary presentations, exercises and other relevant training materials prepared at least two days before the beginning of the training;

 

  • Four-day basic training on mediation in civil/family disputes successfully implemented;

 

  • participants evaluated and list of suitable candidates for future mediators proposed.               
     
Tasks and Responsibilities    
     
   

More precisely the engaged expert will be obliged to:  

             

  • Prepare necessary presentations in relation to the following topics:  basic principles of mediation, and characteristics of the procedure; who can be a mediator, necessary knowledge and skills; cases acceptable and suitable for mediation:

 

  • Prepare relevant practical case exercises related to the phases of mediation process, including: introduction to the mediation process, agreement on the mediation process rules and principles; establishing the trust among parties and mediator, how to pose a question; reframing; skills to identify the positions, attitudes and motives of parties in the process; skills to find the solution of the problem; development of the agreement, etc.

 

  • Prepare all relevant training material for participants;

 

  • Motivate participants to be actively involved in all training sessions;

 

  • In cooperation with other engaged trainers facilitate smooth implementation of the training;

 

  • At the end of the training evaluate work and knowledge of trainees and propose possible candidates for future mediators.                   
     
Necessary Qualifications    
     
   

 

  • University degree in law, political or social sciences, or connected sciences;

 

  • At least 10 years of experience as mediator;

 

  • At least 7 years of experience as trainer for mediators;

 

  • Experience in mediation in the region will be considerable assets;

 

  • Knowledge about the situation related to mediation in Montenegro will be an asset.
