Background    
     
   

Within the framework of its broader mandate to protect and promote the rights of all communities in Kosovo, the Mission monitors, reports and advocates with central and local institutions for full compliance with language-related obligations.

In light of this, through programmatic activities in 2017 the Mission will continue strengthening the capacities of central authorities, i.e. the Office of the Language Commissioner (OLC), to increase their efficiency in protecting the use of all Kosovo’s official languages. Namely, the Mission will support the OLC’s Legal and Compliance Section to develop a unified case management system of complaints submitted to Kosovo institutions by the office.  The system will also assist the OLC to efficiently respond to complaints, issue recommendations, and seek actions by institutions to be taken, in relation to their legal language obligations.

This activity is in line with OMiK mid-term plans on strengthening the capacity of the OLC, and gradual hand-over of activities to the Office.

For the purpose of this activity, OMiK will recruit a local legal expert, to provide support and advice to the OLC for a period of approximately 70 working days. The consultant’s primary duty will be to manage the process of developing a complaints management system, including the development of complaint forms to be used by the public. The consultant’s secondary duty will be to provide on-the-job training for the OLC staff working in the Legal and Compliance Section on how to use the management system and how to draft formal responses and recommendations.

 

Objective

  • To develop a case management system for OLC, including drafting of legal opinions and recommendations and filing of complaints submitted to the Office of the Language Commissioner
  • To coach relevant OLC staff on methods to handle complaints and manage the new tracking system.
     
Tasks and Responsibilities    
     
   

The local consultant will develop complaints tracking system for the OLC, and deliver on-job-training for staff of the Legal and Compliance Section. This will include:

  • Conducting a desk research into legal and normative basis for the use of languages in Kosovo
  • Arranging and conducting meetings with municipal language focal points to identify the common causes of complaints
  • Provide legal advice and assistance to the OLC to implement an effective remedy strategy on handling complaints and legal drafting
  • Identify the legal gaps in the current complaint forms used by the OLC and propose immediate measures for redress
  • Provide advice on legal drafting of recommendations submitted by the OLC to the public institutions
  • Development of forms for complaints, including in electronic form
  • Train/increase the capacities of the OLC staff in identifying and building the legal case/justification rationale for breach of certain language right
  • Delivery of on-job training to help complaint handling and legal drafting.

Deliverables

  • Within two weeks of the commencement of the assignment, and in consultation with the OSCE project manager, the local legal advisor shall prepare a draft work plan for the OMIK. The draft plan will be shared with the OLC. It shall include detailed list of tasks and activities to be carried out against a timeline for their completion
  • On a fortnightly basis: a written overview of work completed and meetings held; a tentative work plan for the following two weeks
  • After 30 days of assignment: draft overview of the achieved results against the detailed list of tasks and activities (1st progress report)
  • After 70 days of assignment: draft overview of the attached results against the detailed list of tasks and activities (2nd progress report)
  • At the end of the assignment: A final evaluation report on completed activities and tasks

Performance Indicators

The main performance indicators are:

  • Detailed work plan of tasks and activities for the 120-day assignment period
  • Meeting minutes
  • Fortnightly reports
  • Development of forms for complaints
  • Deliver of on-the-job training
  • Final evaluation report
     
Necessary Qualifications    
     
   
  • University degree in law (mandatory); Post-graduate degree related to human rights and proven knowledge in this field is an asset
  • At least five years of experience in the field of legal drafting, including work within the rule of law/human rights institutions , report writing and research
  • Proven ability to work according to a set methodology
  • Desirable: good range of working contacts with the key local in Kosovo in the field of language
  • Good IT skills and data management experience
  • Sound gender-related experience
  • Sound organisational and administrative skills
  • Professional fluency in English is mandatory
  • Excellent knowledge of Albanian language and Serbian languages
     
Remuneration Package    
     
    Remuneration will depend on the qualifications and experience of individual experts as well as the detailed work plan to be agreed upon and will be based on the current OSCE consultancy rates.
