Background

 

 

 

 

 

 

 

The Presence’s Rule of Law and Human Rights Department is looking for an international consultant, who will be responsible for producing a manual on the Albanian law no. 146/2014 “On public notification and consultation” and train public consultation coordinators on the said manual. 

During 2017 the Presence, in light of the RLHRD portfolio has committed to undertake a project “Towards a more inclusive, coordinated and transparent legislative process” part of which is to support the implementation of the Albanian law on Public Notification and Consultation. In achieving this objective the project has foreseen the organization of a study visit of 8 Albanian officials to the Croatian government in order to learn from their experience with respect to public notification and consultation of draft legislation. The Croatian model in this regard has been identified by the Open Government Partnership as a model of success, and thus their experience has been identified as a useful learning practice for the Albanian officials. The study visit successfully took place between 4-7 April in Zagreb.

 

 

 

Tasks and Responsibilities

 

 

 

 

 

 

 

While updating the Project Manager with the on-going work for the preparation of the deliverables, the International Consultant will be responsible for:

1.Producing a manual on the implementation of the Albanian law no. 146/2014 “On public notification and consultation”.

 

The international consultant will produce a manual for the implementation of the Albanian law no. 146/2014 “On public notification and consultation. The manual will serve as a tool for coordinators for a standardized and systematic implementation of the law. It will encompass a detailed elaboration of the principles, role and obligations of relevant officials in conducting consultative procedures. In particular, the Manual will include concrete steps, deadlines and instructions to be followed by the designated officials in carrying out their responsibilities. The manual will include instructions on how to use the online e-register and how to apply criteria for the selection of important acts to be consulted with the public through organizing consultative meetings. The Manual will also include relevant information in providing feedback to received comments. The manual should also include reference to best practices and international standards applicable to the notification and consultation process. Where relevant the manual shall include examples as guidance to the process, together with reference to other resources for further individual development. 

-Conduct desk research on the applicable legal and institutional framework in Albania, responsible for the notification and consultation process, as well as on the current practices in place in Albania;

-Draft the manual under the guidance of the Project Manager.

2.Provide two-day training to public notification and consultation coordinators on the notification and consultation process as envisaged through the manual.

The international consultant will deliver training to public notification and consultation coordinators on the notification and consultation process as envisaged through the manual. It will be a two-day training, for which the international expert will envisage as well as prepare relevant materials. 

The training shall aim to familiarize the mentioned target group with key principles and procedures to be followed in conducting a consultative process under the law on consultation. The first part of the training will focus on international standards, best practices and the applicable domestic legal framework. Whereas in the second part, the participants will be divided into several working groups and will have the opportunity to gain practical skills on how to use the online E-register, organize consultative meetings and most importantly provide feedback to received comments.  The international expert shall also be responsible for adapting the said materials into a teaching module to be included in the program of the Albanian School for Public Administration.

-The international expert will envisage training and prepare training materials based on the manual;

-The international consultant will deliver a two-day training of public notification and consultation coordinators, with the facilitation of the Project Manager;

-The international consultant will assess the capacity of the coordinators with written questionnaires, before and after the training, in order to measure its impact;

-Adapt training materials to a teaching module to be incorporated in the program of the Albanian School for Public Administration.

Expected Output/Deliverable:

Task no. 1:

Producing a manual on the Albanian law no. 146/2014 “On public notification and consultation” 

1-Outline of the structure of the guidelines within 10 calendar days after the start of contract;

2-First draft of the guidelines within 20 calendar days after the approval of the proposed structure;

3-Final version of the guidelines within 10 days after receiving comments on the first draft.

Task no 2:

Provide two-day training to public notification and consultation coordinators on the notification and consultation process as follows:

1-Provide the training materials (i.e. presentations, evaluation questioners, etc.) for a two day training on the Guidelines produced under Task 1 within 10 days after the approval of the final version of the Guidelines

2-Delivery of two day training in Tirana before end of contract. (Date to be coordinated with the OSCE PiA).

 

 

 

Necessary Qualifications

 

 

 

 

 

 

 

-Advanced university degree in law, public administration, or related field;

-At least five years of professional experience in working with public notification and consultation of legislation;

-Previous experience as trainer and/or moderator;

-Experience in developing training programmes, including manuals or other training materials;

-Very good communication skills with professional fluency in English;

-Experience in producing high quality written publications;

-Experience in working with the public administration will be an asset;

-Experience working in law, or with the public administration in the region will be an asset, such experience in Albania will be a definite asset;

-Ability to work with minimal supervision, in close co-operation with national staff, and under time pressure.

Remuneration Package

 

 

 

 

 

 

 

The OSCE shall provide SSA fee, Daily Subsistence Allowance (DSA) at the Tirana rate for the repsective days and terminal allowances in accordance with the OSCE regulatory framework, subject to submission of appropriate invoices.

In addition, the OSCE shall provide a round-trip ticket for each visit by most economical route, according to the OSCE regulatory framework.
